Mandate

The purpose of the Canadian Centre on Substance Abuse is to promote increased awareness on the part of Canadians of matters relating to alcohol and drug abuse and their increased participation in the reduction of harm associated with such abuse, and to promote the use and effectiveness of programs of excellence that are relevant to alcohol and drug abuse.

The Board of the Canadian Centre on Substance Abuse shall consist of:
  • the Chairperson and up to four other directors appointed by the Governor in Council on the recommendation of the Minister of Health, after the Minister has consulted with the Board, to hold office during pleasure, for terms not exceeding three years. The Chairperson and the directors are eligible for re-appointment, but no person may be appointed more than three times; and
  • up to eight directors appointed by the Board to hold office during pleasure, after consultations with the governments of the provinces and with any individuals and organizations representative of the business community and labour, professional and voluntary organizations having a particular interest in alcohol and drug abuse that the Board considers appropriate.
The term of office of the directors shall be such as to ensure, in so far as possible, the expiration in any one year of not more than half of the terms of office of the directors.

The Board may elect from among its members a Vice-Chairperson who, in the event of the absence or incapacity of the Chairperson, or if the office of the Chairperson is vacant, has and may exercise and perform all the duties and functions of the Chairperson.

The Board shall, subject to the approval of the Governor in Council, appoint a Chief Executive Officer of the Centre, to hold office during pleasure, who shall have supervision over and direction of the activities and staff of the Centre.

The Board may authorize any member of the Board or any officer or employee of the Centre to act as CEO of the Centre in the event that the CEO is absent or incapacitated or if the office of the CEO is vacant, but no such authorization is valid for more than one hundred and eighty days unless approved by the Governor in Council.

The Deputy Minister of Health and the Deputy Minister of Public Safety and Emergency Preparedness or a delegate of each of those Deputy Ministers, are entitled to receive notice of all meetings of the Board, and may attend and take part in, but not vote, at such meetings.

Consultation

The Canadian Centre on Substance Abuse Act specifies that the Chairperson and up to four other directors may be appointed by the Governor in Council, to hold office during pleasure, after consultation by the Minister of Health with the Board.

Up to eight directors may be appointed by the Board, to hold office during pleasure, after consultations with the governments of the provinces and with any individuals and organizations representative of the business community and labour, professional and voluntary organizations having a particular interest in alcohol and drug abuse the the Board considers appropriate.

The President is the Chief Executive Officer of the CIHR and is responsible for its day-to-day management and direction.

In the event of the absence or incapacity of the President or a vacancy in that office, the Governing Council may authorize an officer of the CIHR to act as President, but no person may act as President for a period exceeding 90 days without the approval of the Governor in Council.

There shall be a Governing Council of the Canadian Institutes of Health Research consisting of not more than eighteen members, one of whom shall be the President of the Canadian Institutes of Health Research and one of whom shall be the Deputy Minister of Health who is a non-voting member.

Each initial member of the Governing Council other than the President, shall be appointed by the Governor in Council to hold office for any term of not more than three years that will ensure, as far as possible, the expiry in any one year of the terms of office of not more than one third of the members. Subsequently appointed members shall be appointed by the Governor in Council for a three-year term.

The members shall be appointed to hold office during pleasure. They may be appointed to no more than two consecutive terms.

The Governor in Council shall appoint as members of the Governing Council women and men who are able to contribute to the achievement of the objective of the Canadian Institutes of Health Research in the overall interests of Canadians. The Governor in Council shall consider appointing women and men who reflect the highest standards of scientific excellence and women and men who reflect a range of relevant backgrounds and disciplines.

The President is the Chairperson of the Governing Council.

The Governing Council shall elect one of its members to be a Vice-Chairperson.

In the event of the absence or incapacity of the Chairperson or if the office of the Chairperson is vacant, the Vice-Chairperson has and may exercise all the powers and perform all the duties and functions of the Chairperson.

Patent Act

The Board consists of not more than five members appointed by the GIC to hold office during good behaviour for a period of five years but may be removed at any time by the GIC for cause. The members are also eligible to be reappointed for one further term.

The GIC shall designate one of the members to be Chairperson and one to be Vice-Chairperson.

The Chairperson is the chief executive officer of the Board and has supervision over and direction of the work of the Board.

A person may continue to act as a member of the Board after the expiration of the person's term of appointment in respect of any matter in which the person became engaged during the term of appointment.

If the Chairperson is absent or incapacitated or if the office of Chairperson is vacant, the Vice-Chairperson has all the powers and functions of the Chairperson during the absence, incapacity or vacancy.

The Minister may establish an advisory panel to advise the Minister on the appointment of persons to the Board, which panel shall include representatives of the provincial ministers of the Crown responsible for health, representatives of consumer groups, representatives of the pharmaceutical industry and such other persons as the Minister considers appropriate to appoint.

Consultation

The Patent Act specifies that the Minister shall consult with an advisory panel (if established by the Minister) for the purpose of making a recommendation to the Governor in Council with respect to the appointment of a person to the Board.

The Chief Public Health Officer shall provide the Minister and the President with public health advice that is developed on a scientific basis.
